Magistrate Hon. Sinvula delivered the ruling this morning, holding that the prosecution had established a prima facie case sufficient to place the accused on his defence. It is alleged that in April 2022, Mr. Nakachinda uttered remarks to the effect that Zambians had picked &#8220;the most ignorant person from Bweengwa&#8221; and taken him to State House. He denies the charge. At this stage, the court is not deciding guilt. It is determining whether the State has led sufficient evidence that, if unchallenged, could sustain a conviction. Had the evidence been insufficient, the accused would have been acquitted immediately. Having found it sufficient, the court has now placed Mr. Nakachinda on his defence. Magistrate Sylvia Munyinya handed down a fine of K2,400, ordering immediate payment or default imprisonment of three months. The conviction stems from public utterances made in September 2024, in which Nakacinda alleged that law enforcement agencies were planning a raid on the Chifwema residence of the late former President Edgar Lungu.
