DPP Emerges Victorious in Forfeiture Case Against Tasila Lungu. In a significant legal victory, the Director of Public Prosecutions (DPP) emerged victorious in a Non-Conviction Based Forfeiture case against Tasila Lungu, daughter of Former President Edgar Chagwa Lungu. The court’s ruling on the 19th of March, 2024, reaffirmed the DPP’s legal jurisdiction and upheld the integrity of the legal process. The genesis of this legal discourse traces back to the initiation of Non-Conviction Based Forfeiture proceedings by the DPP, represented as the Applicant. Supported by an affidavit sworn by senior investigations officer Emmanuel Khondowe of the Drug Enforcement Commission (DEC), the DPP unveiled a stark contrast between Tasila Lungu’s declared income and amassed assets. Empowering Asset Management: Zambia’s Visionary Approach.

Asset recovery serves as a powerful tool in combating illicit financial activities by sending a clear message that crime crime does not pay and that perpetrators will face consequences for their actions. It is widely recognised that transparent and accountable management of criminal assets is crucial to the asset recovery process. Effective management of these assets requires specialised skills and a need for decision-making independence among those overseeing them. In light of these considerations, it is suggested that pairing asset recovery and asset management functions within a single institution would be more logical, efficient, and effective. Zambia is contemplating adopting a multi-agency approach to target the forfeiture of proceeds from criminal activities. NPA Launches Handbook for Prosecutors on the Management of Gender Based Violence cases in Zambia

Today, on the eve of International Womens’ day, the National Prosecution Authority launched its first ever Handbook for Prosecutors on the Management of Gender Based Violence cases in Zambia. Speaking at the launch, the Director of Public Prosecutions, Mr Gilbert Phiri, SC stated that Gender Based Violence (GBV) is a cancer that needs to be stamped out in order to create a safe and equitable society where women and girls can thrive. Mr Phiri further stated that as the gatekeeper of the criminal justice system, the NPA has the duty to ensure that victims of GBV access timely and victim centred prosecution services which safeguard their wellbeing whilst upholding their dignity and privacy. The People vs. Sibetta Sibetta – Case No. RMAO/350/22

Introduction Welcome to the first segment of our Conviction Updates series. The aim of this series is to share recent judgments of public interest. Today, we share the legal outcome of a case involving Sibetta Sibetta, a former Assistant Immigration Officer in the Ministry of Home Affairs. Case Overview Sibetta faced 117 Counts, including Forgery and Theft by Public Servant charges. He was accused of forging bank deposit slips and stealing US$165,900 between August 2014 and January 2021 in Nchelenge, Luapula Province. Legal Proceedings Despite pleading not guilty, Sibetta was found guilty after trial before Resident Magistrate Mbewe in Nchelenge. Sentencing Resident Magistrate Mbewe sentenced Sibetta to five years in prison with hard labour, with effect from December 22, 2023. The Court also ordered him to repay the stolen amount. Historical Milestone achieved as Zambia Law Enforcement Agencies sign first ever National Financial Investigations and Asset Recovery Curriculum

Today, signalled a momentous milestone in law enforcement as all Heads of the 21 institutions under the Inter-Agency Task Force led by the Director of Public Prosecution, the Chairperson, showed their collective and conscious resolve to cooperate and coordinate in the fight against financial crimes and asset recovery by the signing of the training curriculum in financial crime investigation and asset recovery. Zambia continues to benefit from the global forum on asset Recovery action series.

The Global Forum for Asset Recovery (GFAR) is a platform organised by Stolen Asset Recovery (StAR) that empowers investigators and prosecutors responsible for identifying and tracing assets. It facilitates necessary cooperation with financial centres to recover and return assets. Star, a partnership between the World Bank and the United Nations Office on Drugs, was established in 2007 to support countries in implementing Chapter V of the United Nations Convention against Corruption (UNCAC). StAR actively engages with ongoing cases, provides capacity building and technical assistance to countries, and participates in global conferences related to asset recovery. In September 2023, Zambia became a focus country in GFAR during a meeting in Vienna, featuring eight bilateral engagements with jurisdictions of interest.
