The People v. Emmanuel Chunga

Case OverviewEmmanuel Chunga faced 34 Counts of Causing Death by Dangerous Driving. He was accused of having caused the deaths of 34 people on 3rd September, 2023 at Luano in the Luano District of the Central Province by driving his motor vehicle namely Scania Truck registration number BAL 4689 ZM along Masansa- Mboroma Road. On the material day, he was carrying 58 passengers in his truck together with a number of assorted goods. 34 of his passengers died on the spot whilst 24 sustained body injuries after he failed to negotiate a curve, due to the excessive speed he was driving at. Justice Served in High-Profile Embezzlement Scheme – Court Recognises Victim in Forfeiture Judgment. In a significant victory for the National Prosecution Authority, the Economic and Financial Crimes Court (EFCC) has delivered a judgment in the Ngucha case, ordering the forfeiture of assets worth millions of Kwacha to the State. The case involved a sophisticated embezzlement scheme that took place between January 1 and December 31, 2019, in which a staggering K7,755,472.32 was stolen through fictitious credit transactions. The managers of various service stations masterminded the scheme, using their positions to create fictitious credit transactions, deposit less cash sales from the purported transactions, and steal the difference. Transforming Masculinity: Zambia’s Coaching Boys to Men Initiative.

Chali Mbewe-Hambayi the head of the Gender Based Crimes Department at the National Prosecution Authority, chaired a significant side event during the 68th session of the Commission on the Status of Women at the United Nations headquarters in New York. The side event was under   the theme “The Impact of the Coaching Boys in to Men Programme ” which is a collaborative initiative between the Zambia Centre for Communication Programmes and the government of Zambia. This programme aims to address harmful gender norms prevalent among boys which undermine the quest for gender equality and empowerment for women and girls.  The program seeks to instill positive masculinity and promote non-violent conflict resolution methods. NPA Launches Handbook for Prosecutors on the Management of Gender Based Violence cases in Zambia

Today, on the eve of International Womens’ day, the National Prosecution Authority launched its first ever Handbook for Prosecutors on the Management of Gender Based Violence cases in Zambia. Speaking at the launch, the Director of Public Prosecutions, Mr Gilbert Phiri, SC stated that Gender Based Violence (GBV) is a cancer that needs to be stamped out in order to create a safe and equitable society where women and girls can thrive. Mr Phiri further stated that as the gatekeeper of the criminal justice system, the NPA has the duty to ensure that victims of GBV access timely and victim centred prosecution services which safeguard their wellbeing whilst upholding their dignity and privacy. Introduction Welcome to the first segment of our Conviction Updates series. The aim of this series is to share recent judgments of public interest. Today, we share the legal outcome of a case involving Sibetta Sibetta, a former Assistant Immigration Officer in the Ministry of Home Affairs. Case Overview Sibetta faced 117 Counts, including Forgery and Theft by Public Servant charges. He was accused of forging bank deposit slips and stealing US$165,900 between August 2014 and January 2021 in Nchelenge, Luapula Province. Legal Proceedings Despite pleading not guilty, Sibetta was found guilty after trial before Resident Magistrate Mbewe in Nchelenge. These court judgments are an exhibition of the NPA’s dedication and commitment to fighting financial and economic crime.
